1. Acceptance of Terms
By accessing and using NEXAM ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Use License
Permission is granted to temporarily access the materials (information or software) on NEXAM's Platform for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- Modify or copy the materials
- Use the materials for any commercial purpose, or for any public display (commercial or non-commercial)
- Attempt to decompile or reverse engineer any software contained on NEXAM's Platform
- Remove any copyright or other proprietary notations from the materials
- Transfer the materials to another person or "mirror" the materials on any other server
3. User Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
4. Booking and Payments
All bookings made through the Platform are subject to acceptance by the artist or service provider. NEXAM acts as an intermediary platform and is not responsible for the actual performance or services provided.
Payment terms are agreed between organizers and artists. NEXAM may hold payments in escrow until service completion. A service fee or commission may be charged on successful bookings.
5. Cancellation and Refunds
Cancellation policies are set by individual artists and service providers. Refunds are subject to the cancellation policy agreed upon at the time of booking. NEXAM's booking guarantee may apply in cases of artist no-show or breach of contract.
6. User Conduct
You agree not to use the Platform to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit any harmful code or malware
- Harass, abuse, or harm other users
- Post false, misleading, or fraudulent content
- Engage in any form of spam or unauthorized advertising
7. Content Ownership
Users retain ownership of content they post on the Platform. By posting content, you grant NEXAM a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on the Platform.
8. Disclaimer
The materials on NEXAM's Platform are provided on an 'as is' basis. NEXAM makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
9. Limitations
In no event shall NEXAM or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on NEXAM's Platform.
10. Modifications
NEXAM may revise these terms of service at any time without notice. By using this Platform you are agreeing to be bound by the then current version of these terms of service.
